Due to the decision by a federal judge, President Barack Obama and the U.S. Food and Drug Administration (FDA) have no authority in regards to the regulation of electronic cigarettes...Washington (SmartAboutHealth) - Due to the decision by a federal judge, President Barack Obama and the U.S. Food and Drug Administration (FDA) have no authority in regards to the regulation of electronic cigarettes.

U.S. District Judge Richard J. Leon ruled this week in favor of makers of electronic cigarettes, stating that the FDA does not have the power, nor does the Obama administration, to regulate these products.

According to the 32-page ruling, these products are out of the realm of the FDA’s ability to regulate them.

This was a major victory for Smoking Everywhere, Inc. who makes these electronic cigarettes along with similar companies.

The FDA has been trying to ban the use of electronic cigarettes, stating that they were similar to drugs and other medical devices.

These products though apparently do not fall under that type of regulation after all.

Electronic cigarettes are powered by a battery and are filled with liquid nicotine.

The fear by the FDA was that these were being seen as being safer than regular cigarettes.
